Agreement
These Terms of Service ("Terms") govern your access to and use of the Streakeats website and application (the "Service"), operated by Streakeats LLC ("Streakeats," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information.
If you do not agree, do not use the Service. If you use the Service on behalf of a restaurant or business, you represent that you have authority to bind that business to these Terms.
The Service
Streakeats helps customers build visit streaks at participating restaurants and unlock perks offered by those restaurants. Restaurants use Streakeats to list their business, configure streak perks, verify in-person check-ins (for example via PIN or QR), and manage related operations.
We may change, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability.
Eligibility
You must be at least 13 years old (or the minimum age required where you live) to use the Service, and you have the legal capacity to form a binding contract. Restaurant accounts must be operated by authorized representatives of the business they register.
Accounts
You are responsible for your account credentials and for activity under your account. Keep your information accurate and notify us if you suspect unauthorized access.
Service communications
By creating an account, you agree that we may send transactional or service-related messages about your account, streaks, perks, security, restaurant tools, or changes to the Service. Marketing messages may be subject to separate consent and unsubscribe options. You can opt out of non-essential marketing messages where available.
Termination
We may suspend or terminate your account or access to the Service at any time, with or without notice, including if we believe you violated these Terms, created risk for users, restaurants, or the Service, were inactive, or if required for legal or security reasons. Upon termination, your right to use the Service ends immediately, but certain provisions (such as disclaimers, liability limits, and indemnification) survive.
Perks and streaks
Streaks, perk tiers, expiration windows, eligibility requirements, and redemption rules may vary by restaurant. Restaurants may update, pause, or remove perks, subject to any limitations shown in the Service. A perk is not guaranteed until it is confirmed by the restaurant at checkout.
Restaurant perks are offered and fulfilled solely by the participating restaurant. Streakeats is not responsible for a restaurant's refusal, failure, or inability to honor any perk, discount, reward, or promotional offer. Streakeats may, but is not obligated to, investigate or take action against restaurants that fail to honor published perks.
Streakeats may correct streaks, reverse check-ins, remove perks, suspend or remove restaurant listings, or remove restaurants from the Streakeats network if we believe there was error, fraud, abuse, misuse of the Service, inaccurate offers, failure to honor published perks, or other conduct that creates risk for customers, restaurants, or Streakeats.
Customer use
When using Streakeats as a customer, you agree that you will:
- Check in only for yourself, in person, at the restaurant where you are paying
- Follow each restaurant's stated perk rules and staff instructions at checkout
- Not falsify visits, share verification codes to abuse streaks, or circumvent verification
- Not use the Service for unlawful, harassing, or fraudulent purposes
Disputes about how a specific perk was applied at checkout should be resolved with the restaurant; we may help with account or technical issues where appropriate.
Restaurant operators
When you register or manage a restaurant on Streakeats, you agree that you will:
- Provide accurate business, contact, and listing information
- Only offer perks you intend to honor for qualifying customers
- Confirm perk tiers before they are shown to customers, and keep offers accurate and active
- Verify customers in person before awarding streaks, consistent with your chosen verification method
- Comply with applicable laws, including consumer disclosure and alcohol or discount rules where relevant
- Maintain appropriate staff access levels and protect merchant tools from misuse
Restaurant operators are responsible for all activity by staff or users they invite to manage their location.
You are solely responsible for perks you publish, staff actions at your location, tax treatment of discounts, and compliance with your own policies. Listing on Streakeats does not constitute our endorsement of your business. Restaurants are independent businesses, not employees, agents, or representatives of Streakeats.
We may review listings, Google Maps connections, and applications before a restaurant appears publicly. We may remove or hide listings that are incomplete, inaccurate, inactive, or violate these Terms.
Payments
Customer orders placed through Square-connected in-app checkout are processed by Square. For each completed in-app order, Streakeats LLC collects a $0.03 platform fee from the restaurant operator's Square payout via Square's application fee feature. Customers pay the order total shown at checkout; the platform fee is not added to the customer price.
If we introduce additional paid features, subscriptions, or restaurant operator plans, those charges will also be processed by third-party payment processors. You agree to pay all applicable fees in full at the time of purchase. Fees are non-refundable except as expressly stated in the Service or as required by applicable law. We will notify you in advance of any new or increased charges.
Streak program
Streakeats uses one customer streak across participating restaurants. You must check in at least once every seven days to keep your streak active. Perk eligibility and redemption rules are described in the Service and may change at any time.
Acceptable use
You may not:
- Reverse engineer, scrape, or overload the Service without permission
- Use automated tools, bots, scripts, or AI to access, scrape, or interact with the Service without permission
- Upload malware, infringing content, or misleading listings
- Impersonate others or misrepresent affiliation with a restaurant
- Interfere with verification, streaks, or security controls
Content and intellectual property
The Service, branding, and software are owned by us or our licensors. You retain ownership of content you submit (for example, menu items, photos, and perk descriptions) and grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, display, use, modify, and promote that content to operate, promote, and improve the Service.
You may not submit content that is false, misleading, unlawful, infringing, offensive, or violates another person's rights. We may remove content that violates these Terms or that we believe may create risk for Streakeats, users, or partners.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ACCURATE RESTAURANT HOURS, MAP DATA, PERK AVAILABILITY, OR UNINTERRUPTED ACCESS. WE DO NOT GUARANTEE THAT ANY RESTAURANT WILL HONOR PERKS OR THAT STREAK PROGRESS WILL BE SAVED IN ALL CASES.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF YOU HAVE NOT PAID US ANY AMOUNTS.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your use of the Service, your content, your perks or business operations (for restaurants), or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.
Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules that would apply another state's laws, except where mandatory consumer protection laws in your jurisdiction require otherwise.
Any disputes arising from these Terms or the Service that cannot be resolved informally must be brought exclusively in the state or federal courts located in Pinellas County, Florida.
You agree to waive any right to a jury trial in any legal proceeding.
Changes
We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. We may notify you of material changes via email or in-app notification. Continued use after changes become effective constitutes acceptance of the revised Terms, except where prohibited by law.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
